Terms of Service

1. Acceptance of Terms

By submitting an inquiry through Lost and Found Japan (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute the entire agreement between you and Lost and Found Japan regarding your use of the Service and supersede all prior agreements.

2. Service Description

Lost and Found Japan provides lost item retrieval assistance and international shipping services. Upon receiving your inquiry, we may contact the relevant Japanese facility, including airports, hotels, train operators, police stations, and other organizations, to assist with locating, verifying, retrieving, and shipping your lost item. We do not guarantee the recovery of any item. The availability, condition, release, and retention of lost items are determined by the facility holding the item and are outside our control.

3. Fees and Payment

Our standard service fee is charged only upon successful recovery and confirmation of your item. If we are unable to recover your item, no standard service fee will be charged unless otherwise agreed in advance. In addition to the service fee, you may be responsible for: • Shipping costs based on the item, destination country, package dimensions, and available shipping methods • Any applicable customs duties, taxes, or import charges imposed by the destination country • Any additional costs incurred by the facility holding the item or other third parties, where applicable We will communicate known fees and estimated costs before requesting payment whenever reasonably possible. Payment must be completed before shipment unless otherwise agreed.

4. No Guarantee of Recovery

Lost and Found Japan acts as an intermediary between you and the facility holding the lost item. We cannot guarantee that: • The facility still holds your item • The item is in the same condition as when it was lost • The facility will respond to or cooperate with our inquiry • The facility will release the item to us or to you • Ownership of the item can be satisfactorily verified • Recovery will occur within any specific timeframe The recovery, release, retention, and disposal of lost items are determined solely by the facility holding the item and applicable laws or policies. We will communicate the outcome of our inquiry promptly and accurately.

5. User Obligations

By using the Service, you agree to: • Provide accurate, complete, and truthful information regarding your lost item and inquiry • Respond promptly to our communications and requests for information • Provide any documentation reasonably required to verify ownership of the item or authorize retrieval, when requested • Provide a valid shipping address and contact information when requested • Ensure that the item claimed rightfully belongs to you or that you are authorized to act on behalf of the owner • Comply with all applicable laws and regulations relating to the import, export, shipment, and receipt of goods Lost and Found Japan reserves the right to suspend or cancel an inquiry if inaccurate, incomplete, misleading, or fraudulent information is provided. Any fees already paid may be non-refundable where permitted by law.

6. Prohibited and Restricted Items

Lost and Found Japan does not handle, retrieve, or ship items that are prohibited or restricted by applicable laws, carrier regulations, facility policies, or destination country import requirements. Examples include, but are not limited to: • Illegal drugs, controlled substances, or narcotics • Weapons, ammunition, explosives, or other dangerous goods • Cash or negotiable instruments. Due to Japan's regulations regarding money handling and anti-money laundering laws, we are not permitted to handle cash on behalf of others, as we are not a licensed funds transfer service provider. • Power banks, portable chargers, and certain lithium battery products that may be restricted by carriers or destination countries • Charging cases for wireless earbuds and other battery-powered accessories that may be subject to shipping restrictions • Prescription medications, over-the-counter medications, supplements, or other health-related products that may be restricted by law or carrier regulations • Items prohibited by shipping carriers, customs authorities, or destination country regulations • Items subject to export controls, trade sanctions, or other legal restrictions We reserve the right to refuse service for any item that we determine cannot be legally or safely retrieved, transported, exported, imported, or delivered. If a prohibited or restricted item is identified, the inquiry may be canceled immediately. Any fees incurred prior to cancellation, including administrative, retrieval, shipping, or third-party costs, may remain payable and non-refundable to the extent permitted by law.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Lost and Found Japan shall not be liable for: • Failure to locate, recover, retrieve, release, or deliver a lost item • Loss of, damage to, deterioration of, or alteration to an item while in the possession of a third-party facility, carrier, customs authority, or other third party • Delays caused by facilities, carriers, customs authorities, government agencies, or other third parties • Customs inspections, delays, duties, taxes, import restrictions, seizures, or refusals by destination country authorities • Inaccurate, incomplete, misleading, or incorrect information provided by the user • Any indirect, incidental, consequential, special, or punitive damages, including loss of use, loss of opportunity, travel disruption, emotional distress, or loss of profits Lost and Found Japan acts solely as an intermediary and service coordinator. We do not own, control, or operate the facilities, carriers, or government authorities involved in the recovery, handling, transportation, or delivery of lost items. To the fullest extent permitted by applicable law, our total liability arising from or relating to any inquiry or service shall not exceed the total service fees actually paid to Lost and Found Japan for the applicable inquiry.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect, use, store, and process personal information only as reasonably necessary to provide the Service, verify ownership of lost items, coordinate with facilities holding lost items, arrange shipping, comply with legal obligations, and protect our legitimate business interests. Where necessary to facilitate the recovery or return of a lost item, we may share relevant information with the facility holding the item, shipping carriers, customs authorities, or other parties directly involved in providing the Service. We take reasonable measures to protect personal information and handle it in accordance with our Privacy Policy and applicable laws.

9. Termination

Lost and Found Japan reserves the right to refuse, suspend, or cancel any inquiry or service at its sole discretion, including but not limited to circumstances involving: • Suspected fraud, unlawful activity, or misuse of the Service • Abusive, threatening, or inappropriate behavior toward our staff or third parties • Violation of these Terms • Failure to provide requested information, documentation, or proof of ownership • Extended periods of non-response by the user • Circumstances that make retrieval, shipment, or delivery impracticable, unlawful, or impossible If an inquiry is canceled, any refund will be determined based on the services already performed, costs incurred, and applicable circumstances. Lost and Found Japan reserves the right to retain amounts necessary to cover administrative, retrieval, shipping, or third-party costs already incurred.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the Saitama District Court as the court of first instance.

11. Changes to These Terms

Lost and Found Japan reserves the right to modify or update these Terms at any time. Any changes will become effective upon posting the revised Terms on our website with an updated effective date, unless otherwise required by applicable law. Your continued use of the Service after the effective date of any revised Terms constitutes your acceptance of the updated Terms.
